Welcome to The Cove Charleston! The terms “we,” “us” and “our” refer to BBB CAPITAL LLC, doing business as The Cove Charleston. BBB CAPITAL LLC operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the “Services”). The Cove Charleston is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein, collectively constitute these “Terms of Service” or “Terms” and describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

SECTION 1 - ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence and that you have given consent for any minor dependents to use the Services on devices you own, purchase or manage.

To access or use certain Services, including purchasing products, you may be asked to provide information such as your email address, billing information, payment information and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have the necessary right to provide it.

You are responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately represent our products and services. However, colors and product appearance may vary based on your screen, device settings, lighting and other factors outside our control.

We do not warrant that a product’s appearance or quality will meet every personal expectation or appear exactly as depicted on your device.

Product descriptions, pricing and availability may change at any time without notice. We reserve the right to discontinue products and to limit the quantities offered to any person, geographic region or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. The Cove Charleston reserves the right to accept or decline an order for any lawful reason. An order is not accepted until payment has been received and processed and The Cove Charleston confirms acceptance.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation or modification requests after an order has been accepted or entered processing.

If we decline, change or cancel an order, we will attempt to notify you using the email address, billing address or telephone number provided with the order.

Your purchases and any return eligibility are governed exclusively by our Return and Refund Policy.

You represent and warrant that your purchases are intended for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged will be the price in effect when the order is placed and will appear in the order confirmation.

Unless otherwise expressly stated, displayed prices do not include applicable sales or use taxes, shipping charges or handling charges.

Prices displayed online may differ from prices previously offered, offered through promotions or offered by third parties. Promotions may have separate terms and conditions. If a conflict exists between a promotion’s terms and these Terms, the promotion’s terms will control.

You agree to provide current, complete and accurate purchasing, payment and account information and to promptly update information necessary to complete transactions or contact you.

You represent and warrant that:

  1. The payment information you provide is true, correct and complete.
  2. You are authorized to use the selected payment method.
  3. Charges incurred will be honored by your payment provider.
  4. You will pay all authorized charges, including applicable shipping charges and taxes.

SECTION 5 - SHIPPING AND DELIVERY

The Cove currently ships within the United States only. Standard U.S. shipping is $10. Complimentary U.S. shipping is available on qualifying orders of $150 or more. Boutique pickup is available for eligible orders at our Daniel Island location.

Shipping and delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, incorrect or incomplete delivery information or events outside our reasonable control.

The shipping rate and delivery options displayed at checkout control your order. Risk of loss passes to you when the carrier confirms delivery to the shipping address provided with your order.

SECTION 6 - INTELLECTUAL PROPERTY

The Services, including trademarks, brands, text, displays, images, graphics, product reviews, video, audio and the design, selection and arrangement thereof, are owned by BBB CAPITAL LLC, The Cove Charleston, their affiliates or their licensors and are protected by applicable United States and international intellectual-property laws.

These Terms permit you to use the Services only for personal, noncommercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit materials from the Services without prior written consent, except as permitted by applicable law.

Nothing in these Terms grants you any license or right under any patent, trademark, copyright or other intellectual property belonging to The Cove Charleston, Shopify or another party.

The Cove Charleston’s name, logo, product names, service names, designs and slogans are trademarks belonging to BBB CAPITAL LLC, The Cove Charleston or their licensors. They may not be used without prior written permission. Shopify’s name, logo, product names, service names, designs and slogans are trademarks of Shopify. Other names, logos, designs and slogans appearing through the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may receive access to tools provided by third parties that we do not monitor or control.

Access to these tools is provided “as is” and “as available” without warranties, representations, conditions or endorsements. To the fullest extent permitted by law, we are not liable for claims arising from your use of optional third-party tools.

Your use of optional tools is at your discretion and risk. You are responsible for reviewing and accepting the terms under which the applicable provider offers those tools.

New features, tools or resources offered through the Services in the future will also be considered part of the Services and subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain materials, functionality or links provided by third parties. We are not responsible for examining or evaluating the content, accuracy, security or practices of third-party websites or services.

If you leave the Services to access a third-party website or service, you do so at your own discretion and risk.

We are not responsible for claims or damages related to third-party websites or your purchase or use of third-party products, services, resources or content. Review the applicable third party’s policies and practices before completing a transaction. Questions about third-party products or services should be directed to that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

The Cove Charleston is powered by Shopify, which enables us to provide the Services. However, sales and purchases made through our store are transactions directly between you and BBB CAPITAL LLC, doing business as The Cove Charleston.

By using the Services, you acknowledge that Shopify is not responsible for sales between you and The Cove Charleston, including injury, damage or loss resulting from products or services purchased from us. To the extent permitted by law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with The Cove Charleston.

SECTION 10 - PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have read and understand these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes certain information about your access to and use of the Services to provide and improve its services. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside your state or country.

If you submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, proposals, plans or other content (“Feedback”), you grant BBB CAPITAL LLC and The Cove Charleston a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for lawful purposes, including operating, improving and promoting the Services.

You represent and warrant that:

  1. You own or possess the rights necessary to provide the Feedback.
  2. You have disclosed any compensation or incentives received in connection with the Feedback.
  3. Your Feedback complies with these Terms and applicable law.

We are not obligated to maintain Feedback in confidence, pay compensation for Feedback or respond to Feedback.

We may monitor, edit or remove Feedback that we reasonably determine is unlawful, offensive, threatening, defamatory, obscene, infringing or otherwise objectionable.

You may not submit Feedback that violates another party’s copyright, trademark, privacy, publicity or other rights; contains unlawful, abusive or obscene material; includes malware; uses a false identity; or misrepresents its source. You remain responsible for your Feedback and its accuracy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit estimates or availability.

We reserve the right to correct errors, inaccuracies or omissions and to update information or cancel affected orders when information is inaccurate, including after an order has been submitted, subject to applicable law.

You may access and use the Services only for lawful purposes. You may not use the Services, directly or indirectly:

  1. For an unlawful, fraudulent or malicious purpose.
  2. To violate any applicable international, federal, state or local law.

  9. To engage in conduct that restricts another person’s use or enjoyment of the Services or exposes The Cove Charleston, Shopify or users to liability.

You also agree not to:

  1. Upload or transmit viruses, malware or other malicious code.
  2. Reproduce, duplicate, copy, extract, sell, resell or exploit any unauthorized portion of the Services.
  3. Improperly collect or track another person’s personal information.
  4. Spam, phish, pharm, scrape or pretext the Services.
  5. Use robots, spiders, scraping tools, automated data-extraction tools, unauthorized AI agents or other automated or manual means to access the Services in violation of these Terms.
  6. Interfere with, bypass or circumvent security, authorization, robot-exclusion or access-control measures.

We may suspend, disable or terminate access when we reasonably determine that these Terms have been violated.

This section applies if you use, enable or deploy software that autonomously or semi-autonomously acts on behalf of a person or entity to access or interact with the Services (“Agent”).

No Agent may access or interact with the Services unless it identifies itself and complies with the requirements below. An Agent may not access or interact with the Services after we request that it stop.

We may use technical or other measures to control whether and how Agents access or interact with the Services.

Agents must:

  1. Identify requests as originating from an Agent and disclose the Agent’s name in the applicable user-agent string.
  2. Not conceal or misrepresent that activity originates from an Agent.
  3. Not mimic human behavior to evade detection.
  4. Not complete or circumvent CAPTCHAs or similar controls.
  5. Respond truthfully to requests seeking to determine whether activity originates from a person or computer.
  6. Not circumvent measures intended to block, limit or control Agent access.

We may terminate these Terms or suspend or terminate your access to the Services when permitted by law, including when we reasonably determine that you violated these Terms. You remain liable for amounts properly due through the effective date of termination.

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, feedback, disclaimers, limitations of liability, indemnification, severability, governing law and privacy.

SECTION 16 - DISCLAIMER OF WARRANTIES

Information provided through the Services is made available for general informational purposes. We do not warrant that all information is accurate, complete or useful. Reliance on information obtained through the Services is at your own risk, subject to applicable law.

EXCEPT AS EXPRESSLY PROVIDED BY BBB CAPITAL LLC OR THE COVE CHARLESTON, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR PROHIBIT CERTAIN WARRANTY DISCLAIMERS, SO SOME DISCLAIMERS MAY NOT APPLY TO YOU.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BBB CAPITAL LLC, THE COVE CHARLESTON, SHOPIFY AND THEIR RESPECTIVE AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS. IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SECTION 18 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend and hold harmless BBB CAPITAL LLC, The Cove Charleston, Shopify and their respective affiliates, owners, directors, officers, employees, agents, contractors, licensors and service providers from third-party claims, losses, damages or liabilities, including reasonable attorneys’ fees, arising from:

  1. Your material breach of these Terms.
  2. Your violation of applicable law or another party’s rights.
  3. Your unlawful or unauthorized access to or use of the Services.

We will provide reasonable notice of an indemnifiable claim. A delay in providing notice will not relieve you of your obligations unless the delay materially prejudices your ability to respond. We may control the defense and settlement of a claim at your expense, but we will not agree to a settlement imposing nonmonetary obligations upon you without your reasonable consent. You agree to cooperate with the defense of covered claims.

SECTION 19 - SEVERABILITY

If a provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and any unenforceable portion will be severed without affecting the remaining provisions.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms and the policies and operating rules referenced herein constitute the entire agreement between you and us concerning the Services and supersede prior or contemporaneous agreements, communications and proposals concerning the Services.

Any ambiguity in these Terms will not automatically be construed against the drafting party.

SECTION 21 - ASSIGNMENT

You may not transfer, delegate or assign these Terms or your rights or obligations without our prior written consent. Any unauthorized attempted assignment is void.

We may transfer, assign or delegate these Terms and our rights or obligations as permitted by applicable law.

SECTION 22 - GOVERNING LAW

These Terms and any separate agreements through which we provide the Services are governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles.

Except where applicable consumer law requires otherwise, any legal action or proceeding arising from these Terms or the Services shall be brought in a state or federal court having jurisdiction over Berkeley County, South Carolina. You and BBB CAPITAL LLC consent to the personal jurisdiction and venue of those courts.

Headings are included for convenience and do not limit or otherwise affect these Terms.

You may review the current version of these Terms at any time on this page.

We may update, change or replace portions of these Terms by posting an updated version through the Services. When required by applicable law, we will provide notice of material changes. Changes become effective on the date stated in the updated Terms or applicable notice.

Your continued access to or use of the Services after an updated version becomes effective constitutes acceptance of those changes to the extent permitted by law.
